Mission Produce, Inc.  and our subsidiaries and affiliates (“Mission Produce,” “we”, “us” or “our”) provide this Applicant Data Protection Notice to explain how we collect, use, and disclose personal data about job applicants or other potential employees (“Applicant Data“), in connection with our recruiting and hiring activities.

This Applicant Data Protection Notice applies to personal data collected about you in your capacity as a job applicant or potential employee. See our Privacy Policy  for information about our practices when you use our website or otherwise interact with us offline or online in the same manner that a website visitor or someone who is not a job candidate or potential employee may interact with us. This Applicant Data Protection Notice does not create or form part of any contract for employment or otherwise.

If you have any questions about how Applicant Data is processed, please contact as described in Section XII below.

I. CATEGORIES OF APPLICANT DATA

Mission Produce collects, uses, and otherwise processes the following categories of Applicant Data in consideration of your potential employment at Mission Produce:

  • Contact information, such as personal and business address, personal and business phone/fax numbers, email addresses, and LinkedIn profile;
  • Personal and biographical information, such as name, date of birth, nationality, gender/gender identity, pronouns, country of birth, information in your company biography, social media profiles and activity, and your photo;
  • Identification information, such as your social security number, government-issued identification information (e.g., driver’s license, passport), photographs, or other similar identifiers;
  • Immigration status, and other information that would allow us to verify your employment eligibility;
  • Information from the application process, such as any phone-screens, interviews, evaluations, monitoring information, CCTV from on-premises visits, recordings, and outcomes of recruiting exercises;
  • Job preferences, such as desired position and compensation, location preferences, and willingness to relocate;
  • Background check information, such as information necessary to complete background, credit, drug/alcohol and/or other checks (including moving violation records for driving roles) when permitted by law, and information received during these checks;
  • Information needed to understand and assess accommodation requests regarding potential disabilities or other health conditions;
  • Employment qualifications information, such as certificates and degrees obtained, languages spoken and skills, software experience, professional memberships, summaries of strengths and technical areas of expertise, pre-Company work history information (previous employers and positions held, dates, locations, supervisors, responsibilities, salary), resume and cover letter information, references and information obtained from them, and related background check information (to the extent permitted, and in accordance with applicable law); and
  • Other information you may provide to us.

The provision of Applicant Data as described in this Applicant Data Protection Notice may be part of a statutory requirement, contractual requirement under the terms of our recruiting website, or a requirement to carry out the recruitment and hiring process with you.

Providing personal data to us is voluntary. However, not providing your Applicant Data may prevent Mission Produce from carrying out recruiting and hiring activities that impact your potential employment with us.

In certain cases, we may ask you for additional information for purposes of complying with applicable laws.

II. SOURCES OF APPLICANT DATA

We collect personal data directly from you when you apply for a job and throughout the job application or recruitment process.  We may also collect your personal data from other sources and combine it with the personal data you provide us. For example, we may collect your personal data from:

  • Job board websites you may use to apply for a job with us;
  • Prior employers that provide us with employment references;
  • Professional references that you authorize us to contact;
  • Pre-employment screening services, such as background check providers (where permitted by law);
  • Employment agencies and recruiters;
  • Your educational institutions;
  • Other publicly-available sources;
  • Other Company personnel.

We may also automatically collect information from cookies or other tags, pixels, or tracking technologies placed on your device from other websites (e.g., job boards) in order to identify the effectiveness of our recruiting campaigns. We may also collect information related to whether emails sent to you have been opened, in order to better understand the effectiveness of our communications. We refer to these types of data collectively as “Tag Information” in this Applicant Data Protection Notice.

III. PURPOSES AND BASIS FOR PROCESSING APPLICANT DATA

Mission Produce will process Applicant Data for the following purposes. Below we also include, to the extent required under applicable law, the categories of applicant data and legal basis for such processing.

IV. CATEGORIES OF RECIPIENTS

Mission Produce may transfer or disclose your Applicant Data to third parties for the processing purposes described above as follows:

  • Within the affiliated group: We share your Applicant Data with our direct and indirect subsidiaries and affiliates as necessary for the purposes identified above, and in particular to conduct recruiting and hiring activities, and to respond to and comply with requests and legal demands;
  • With certain acquiring or acquired entities: If a Mission Produce business for which you submitted your Applicant Data, in relation to your interest for an employment position, is sold or transferred in whole or in part or if Mission Produce is acquiring and integrating another entity into the Mission Produce entity or business for which you applied for an employment position, your Applicant Data may be transferred to the other entity prior to the transaction (e.g., during the diligence phase) or after the transaction, subject to any rights provided by applicable law, including the laws of the jurisdictions where the other entity is located; and
  • With certain Data Processors. Certain third party service providers such as IT support or HR support providers, whether affiliated or unaffiliated, may receive your Applicant Data to process such data under appropriate instructions (“Data Processors“) as necessary for the processing purposes, in particular to conduct recruiting and hiring activities, comply with applicable laws and employment-related requirements, and other activities.
  • Government authorities, law enforcement and others. Government authorities, law enforcement, courts, and others for the purposes described above.
  • Professional advisors. Lawyers, immigration advisors, and other outside professional advisors who require your information in the course of providing their services.
  • Other parties not listed above but that are identified at or before the point at which we collect your personal data.

V. INTERNATIONAL TRANSFERS

The recipients identified above may be located inside or outside your home jurisdiction. Recipients outside your home jurisdiction might be located in countries that are not deemed to provide an adequate level of protection for personal data from the perspective of your home jurisdiction, including in the United States. Mission Produce takes measures designed to ensure that transfers between jurisdictions are adequately protected as required by applicable data protection law.

VI. RETENTION PERIOD

Your Applicant Data is stored by Mission Produce, and/or our Data Processors, to the extent necessary for the performance of our obligations and for the time necessary to achieve the purposes for which the Applicant Data is collected, in accordance with applicable data protection laws. Mission Produce will generally retain your Applicant Data in accordance with applicable retention policies and procedures, the periods of retention under which are determined by taking into account the time necessary to achieve the purposes for which the personal data is processed, unless retention for a longer period is warranted due to a legal requirement, including the need to support or defend a legal claim that is not yet barred by the applicable statute of limitations.

If you accept an offer from Mission Produce, your Applicant Data will be retained for the duration of your employment with Mission Produce and as necessary in accordance with applicable law and applicable retention policies and procedures.

Where you consent to Mission Produce being able to consider you for employment against future opportunities other than the one(s) for which you originally applied and/or were being considered for, we will keep your Applicant Data on file for such purposes.  You may withdraw this consent at any time by contacting the Recruiting Team in writing (email acceptable).

VII. RIGHTS FOR APPLICANTS LOCATED IN THE EEA, UNITED KINGDOM, AND OTHER JURISDICTIONS OUTSIDE OF THE UNITED STATES

If you have declared your consent regarding certain types of processing activities (for example, via a separate specific consent form), you can withdraw this consent at any time with future effect. Such a withdrawal will not affect the lawfulness of the processing prior to the consent withdrawal.

Pursuant to applicable data protection law, you also have the right to: (1) request access to your Applicant Data; (2) request rectification of your Applicant Data; (3) request erasure of your Applicant Data; (4) request restriction of processing of your Applicant Data; (5) request data portability of your Applicant Data; and/or (6) object to the processing of your Applicant Data. Please note that these aforementioned rights might be limited under the applicable national data protection law.

(i) Right of access: Under certain circumstances, you have the right to obtain from us confirmation as to whether or not Applicant Data about you is processed, and, where that is the case, to request access to such Applicant Data. The access information includes, inter alia, the purposes of the processing, the categories of Applicant Data, the recipients or categories of recipients to whom the Applicant Data has been or will be disclosed, the sources of the Applicant Data, the duration of retention of the Applicant Data, and the technical security measures put in place to safeguard the Applicant Data in case of transfer outside the EEA. However, this is not an absolute right and the interests of other individuals may restrict your right of access. Most information is set out in this Applicant Data Protection Notice, but supplementary information will be provided where necessary. In addition to access, you have the right to obtain a copy of the Applicant Data. Note that, for additional copies requested by you, we may charge a reasonable fee based on administrative costs.

(ii) Right to rectification: Under certain circumstances, you have the right to obtain from us the rectification (i.e., correction) of inaccurate Applicant Data about you. Depending on the purposes of the processing, you have the right to have incomplete Applicant Data completed, including by means of providing a supplementary statement.

(iii) Right to erasure (right to be forgotten): Under certain circumstances, you have the right to obtain from us the erasure of Applicant Data about you. In such cases, we will erase, or render permanently unintelligible, such Applicant Data to the extent required by applicable law.

(iv) Right to restriction of processing: Under certain circumstances, you have the right to obtain from us the restriction of processing of your Applicant Data. In this case, the respective data will be marked and may only be processed by us for certain purposes. However, as Mission Produce processes and uses your Applicant Data primarily for purposes of carrying out a job applicant relationship with you, Mission Produce will in principle have a legitimate interest for the processing which will override your restriction request, unless the restriction request relates to marketing activities (which generally do not apply in the job applicant context).

(v) Right to data portability: Under certain circumstances, you have the right to receive the Applicant Data about you that you have provided to us, in a structured, commonly used and machine-readable format so you can transmit this Applicant Data to another entity.

(vi) Right to objection: Under certain circumstances, you have the right to object, on grounds relating to your particular situation, to the processing of your Applicant Data by us. Where such right applies, we will no longer process the relevant Applicant Data. This is not an absolute right and does not apply in certain situations, such as when processing is necessary to perform the employment contract, to comply with applicable law, or to defend legal claims.

You also have the right to lodge a complaint with the competent data protection supervisory authority.

VIII. CALIFORNIA NOTICE AT COLLECTION

Except as otherwise provided, this section applies to residents of California.  For purposes of this Section VIII, “personal data” and “sensitive personal data” have the meanings given to “personal information,” “sensitive personal information,” or similar terms in the California Consumer Privacy Act of 2018 (as amended by the California Privacy Rights Act of 2020 and as may be further amended from time to time, the “CCPA”).

Your privacy rights. California residents have the rights listed below under the CCPA. However, these rights are not absolute, and in certain cases we may decline your request as permitted by law. In addition, we may not be able to process your request if you do not provide us with sufficient detail to allow us to confirm your identity or understand and respond to it.

  • Information. You can request the following information about how we have collected and used your personal data during the past 12 months:
    • The categories of personal data that we have collected.
    • The categories of sources from which we collected personal data.
    • The business or commercial purpose for collecting or selling personal data.
    • The categories of third parties to whom we disclose personal data.
    • The categories of personal data that we sold or disclosed for a business purpose.
    • The categories of third parties to whom the personal data was sold or disclosed for a business purpose.
  • Access. You can request a copy of the personal data that we have collected about you.
  • Deletion. You can ask us to delete the personal data that we have collected from you.
  • Correction. You can ask us to correct inaccurate personal data that we have collected about you.
  • Opt-out of sales or sharing of personal data. California residents can opt-out of any “sale” of their personal data or “sharing” of personal data for cross-contextual behavioral advertising as such terms are defined under the CCPA.  We do not sell or share personal data of applicants in the manner restricted by the CCPA and have not done so in the preceding 12 months. However, we encourage you to review our Privacy Policy for information about the sale or sharing of personal data that may occur when you interact with us offline or online in the same manner that a website visitor or other non-candidate may interact with us. We do not recruit, and have no actual knowledge of having sold or shared the personal data in the past 12 months of, candidates under age 16.
  • Sensitive Personal Data. You have the right to limit the certain uses or disclosures of sensitive personal data; however, we do not use or disclose sensitive personal data for purposes that California residents have a right to limit under the CCPA.
  • Nondiscrimination. You are entitled to exercise the rights described above free from discrimination as prohibited by the CCPA, including exercising such rights without retaliation.

You may submit requests to exercise your rights to by contacting us as provided in the “Contact Us” section.  We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it. We may need to verify your identity to process your information/know, access, deletion, and correction requests, and we reserve the right to confirm your current California residency. We may require identity verification by requiring you to log into an online account for candidates if you have one, provide information that can help us verify your identity, provide government identification, and/or provide an affidavit under penalty of perjury.

Your authorized agent may make a request on your behalf upon our verification of the agent’s identity and our receipt of a copy of a valid power of attorney given to your authorized agent pursuant to California Probate Code Sections 4000-4465.  If you have not provided your agent with such a power of attorney, you must provide your agent with written and signed permission to exercise your CCPA rights on your behalf, provide the information we request to verify your identity, and provide us with confirmation that you have given the authorized agent permission to submit the request.

Additional information for California residents.

  • We do not attempt to reidentify any deidentified information derived from personal data, except for the purpose of testing whether our deidentification processes comply with applicable law.
  • This Applicant Data Protection Notice generally describes our practices currently and during the preceding 12 months. You should assume that each category of personal data we collect may be disclosed, and may have been disclosed during the preceding 12 months, to each category of other parties listed above.
  • For each category of personal data listed above in Section I (repeated below), the CCPA (Cal. Civ. Code Section 1798.140(v)(1)) requires us to identify the following statutory categories to which it corresponds:

With the possible exception of “contact information”, “job preferences”, and “employment qualifications information”, all of the categories above contain information from which it may be possible to infer sensitive personal data or characteristics of protected classifications under California or federal law if applicable.

IX. THIRD PARTIES

This Applicant Data Protection Notice does not address, and we are not responsible for, the practices of any third parties, which have their own rules for how they collect and use your personal data.  Our links to third party websites or services are not endorsements.

X. CHANGES TO THIS APPLICANT DATA PROTECTION NOTICE

We reserve the right to change this Applicant Data Protection Notice at any time.  The “Last updated” section at the bottom of this Applicant Data Protection Notice indicates when it was last revised.  Any changes will become effective when we post the revised notice on our careers site.

XI. YOUR OBLIGATIONS

Apart from your obligation to provide complete and accurate information in the recruiting process, it is your responsibility to ensure that information you submit does not violate any third party’s rights.

You should keep your personal data on file with Mission Produce up to date and inform us of any significant changes to it.
